One legislative session later, Texas foster care remains broken

According to Justice Jack, Texas has completely ignored her December 2015 orders “to establish and implement policies and procedures to ensure that foster children are free from unreasonable harm.” M.D. v. Abbott, Civil Action No. 2:11-CV-84 (S.D. Tex. 2018).  The legislature attempted to circumvent her orders, but the Justice is not buying it. She found that Defendant’s actions did not cure the constitutional violations. Justice Jack’s final orders to the State will no doubt be appealed but until then, two Monitors have been appointed to assess and report Defendant’s compliance.
